UPDATED: IW Sues Activision

For all you diehard Modern Warfare loyalist I’m sure this is not new for you, as you’ve been following it every step of the way. However for those who did not know court documents filed yesterday by ex-Infinity Ward employees and creators of Modern Warfare series Vince Zampella and Jason West accuse that Activision of setting out to “manufacture a basis” to fire both the founders from the company and to withhold payment of royalties of the game that has made over 1 billion dollars World Wide.

The suit alleges that Activision did not hold up its agreement publishing CEO Mike Griffith signed last March, known as a Memorandum of Understanding (MOU), that gave West and Zampella “creative authority over the development of any games under the Modern Warfare brand (or any Call of Duty game set in the post-Vietnam era, the near future, or the distant future) including complete control over the Infinity WardStudio” and says that no such game can be “commercially released without the written consent of West and Zampella.”

This agreement, which still remains private, also gave West and Zampella the ability to operate Infinity Ward independently and the allowance to develop new intellectual property after the completion of Modern Warfare 2.

The lawsuit states that in the wake of Modern Warfare 2’s success, Activision refused to honor the MOU or the Emplyoment Agreement with West and Zampella, and instead launched a “pre-textual investigation against West and Zampella to create a basis to fire the two co-heads of Infinity Ward before the first Modern Warfare 2 royalty payment.”

The investigation began last month, which the document describes as a very tense and hostile situation between Activision and Infinity Ward employees that were quoted to saying:

 

West and Zampella were interrogated for over six hours in a windowless conference room; Activision investigators brought other Infinity Ward employees to tears in their questioning and accusations and threatened West and Zampella with ‘insubordination’ if they attempted to console them.

 

The lawsuit says the results of the investigation were “pre-ordained” and that Activision provided West and Zampella with a list of “trumped up grounds” for termination in a notice of discharge they both received on Monday, March 1, 2010.

This is all very big news considering MLG’s announcement to house MW:2 games and we plan on continuing to keep you, the community, up-to-date as it happens.

Before everyone jumps on the IW bandwagon below is some more food for thought and what might have actually happened here.  This will shake out in court soon.

“The rumor is that Vince Zampella and Jason West, the two senior executives at Infinity Ward was meeting with a competing publisher. This breaches the contract in place between the studio heads and Activision. It is assumed that the contract in reference to in the SEC filing is the one put in place after Activision’s buyout of Infinity Ward back in 2003. Technically IW is a subsidiary of Activision and owned by the publisher.

Infinity Ward was formed by 22 former employees from the same team that created Medal of Honor for EA back in 2002. The rumor is that the two studio execs met with EA recently breaching their contract with Activision. The discussion is speculated to be around a potential coup to extract the “talent” from IW and partner with EA.

Apparently Activision’s CEO Bobby Kotick got wind of it and axed the two IW heads before they could pull their “loyal team members” out of the studio. The “bouncer” types have been speculated to be at IW offices to ensure that the coup does not happen.

The tension between the studio and Activision is said to stem from unpaid royalties from Modern Warfare 2. Its not unconceivable that IW may have tried to do a “Bungie” but Activision was not as graceful as Microsoft.

That is pretty much the extent of the speculations swirling the Web as of now. I’m curious to know how Activision found out about the secret meetings between IW heads and EA. Could it be that these guys are under constant surveillance?”

BioShock $3 million,GTA IV $15 Million

BioShock franchise is off to a good start, since the takeoff of BioShock 2. Today it was announced that BioShock 2 has surpassed $3 million in sales since its release on the Xbox 360, PC and PlayStation 3. With BioShock 2 quickly catching up to the original game’s 4 million lifetime to date sales, there could be a possible BioShock 3.

Take-Two has some bragging rights because the Grand Theft Auto series has announced that it has reached $15 million units sold worldwide.

MLG 2010

It has been almost two months since the finals of the 2009 season. Today, Major League Gaming has announced details for the 2010 season.

The 2010 season sees many changes. First off, GOW2 is now off the circuit. Coming back to MLG will be the fighting scene. Also joining the Pro Circuit as an official online Pro Circuit Title will be Call of Duty Modern Warfare 2.

Just like last season there will be five stops on the pro circuit. Four of those regular seasons and the last one the National Championship.

The PC Circuit will start at the second stop, which is Columbus, Ohio from June 4-6th.

The first stop of the season will Orlando, Florida. The 2009 finals were also held in Orlando, but the 2010 stop will be held at ESPN Wide World of Sports.

ESEANews launches

Tonight ESEA adds another site to the ESEA Network. The new site, called ESEA News will be providing us, the community, with all the gaming coverage we need.

  From day one the goal of ESEA News has been about providing the best coverage possible. Too often gaming sites get lost in the minutiae of what they’re doing. Thumbnails, lists, movies, blogs, and betting all distract from what the focus of the site should be, the sport of gaming. With that in mind we created this site making sure covering eSports was front and center. We are firmly committed to bringing you all of eSports, and not being one big advertisement for ESEA.   At DreamHack Winter you guys were able to take third place with wins over SoA, k1ck and Millenium. How was that experience in terms of helping your team in future international tournaments?

iIt gave us a good taste of what to expect from some international teams, but we weren’t able to take down the top-tier European teams so we still lack experience in that department. I think, however, it has to help us for Germany as it basically doubled our collective experience versus international teams in an international setting.

In recent months it seems that you guys have fallen off the wagon, with an out of character ESEA season as well as being dominated by EG at the American Finals. To what do you contribute these poor performances and what steps have you taken to improve upon them?

I think we got a bit complacent after Dreamhack Winter as we didn’t get that much practice in before the IEM American Finals due to a lot of our players having final exams that week. The online losses I guess I’d contribute to us taking a break for the holidays, but more than anything I’d say EG became a stronger team and simply beat us straight up, no excuses.

Pandemic set to close doors

Just before midnight tonight, one of the once elite North American organizations, has indicated that they will be closing their doors, effective March 1, 2010.

For Team Pandemic, their initial arrival into the scene with Mark Dolven wasn’t given serious thought from the average gamer, and especially not to the heavyweights at the time. From that underdog mentality, they made a firm move into successful placings, and established very successful teams and divisions across multiple games in their multi-year history.

Effective March 1, TeamPandemic LLC. are shutting the doors on nearly a decade of world champion esports divisions (2002-2010).

From our humble beginnings as an Arkansas LAN team, the blue and white of the Pandemic swirl would evolve into a symbol of gaming’s elite… an icon which gamers worldwide would recognize, Fortune 500 companies once valued and leveraged as a means to reach an entire demographic, yet only a very special and select few were ever lucky enough to wear.


While details are set to be announced at a later date, the press release also indicated that the brand of Pandemic will be kept, to pursue future opportunities.

H2k restocks with Begrip, SpawN

Things keep getting shaken up in Scandinavia. Just after announcing the release of their Counter-Strike squad, H2k has officially announced the signing of the entire Begrip CS team to fill the void.

To some, this comes as little surprise, as various plans were floating around the rumor-mill; needless to say though, many fans are excited about the move from Begrip to H2k, including some of the team themselves.

“Today is a bitter sweet day, but mostly a sweet day. It’s with regret and sorrow we leave our home in Begrip and It’s with a big smile we move in to our new home; H2k,” stated one of the new members, Andre “BARBARR” Moller.

Fans also may be excited to know that Abdisamad “SpawN” Mohamed has announced his retirement from gaming, but has stayed on with H2k to act as the new team’s coach.

H2k has been inserted into the next ESL Pro Series Nordic, and will be looking to represent the organization proudly as the league is slated to begin in April.

Dell/Intel confirmed by ESL

The Electronic Sports League announced yesterday the two main sponsors for the up and coming EPS season. Those two sponsors are Dell and Intel.

The new sponsorship will be supporting Germany, France, Alps, Benelux, United Kingdom, and also Scandinavia, where EPS Nordic is soon to get underway.

There are also plans by Alienware, which is owned by Dell for a new line of products made in part by ESL.

This is the second huge signing by ESL, just recently they announced ASUS as the main sponsor of the European Nations Championship.

H2k.cs Part Ways

According to HLTV.org and a Sweden gaming website organization rakaka.se, H2k Counter-Strike 1.6 squad has lost two of their members. Reports are indicating that Rasmus “GuX” Ståhl and Emil “FYRR73” Karlsson have left to SK-Gaming and Meet Your Makers. It is also noted that ealier this month, SpawN’s team suffered an early exit at the IOL Finals, leading to possibily leaving H2k respectively. Reports from Sweden are spreading that if H2k does lose their 1.6 team, then the organization will try to pick up Begrip Gaming’s roster, which will most likely be consisted of Andrè “BARBARR” Möller and Samuel “Zyppe” Martinsson.

Blizzard Makes $1.1 Million Donation

Blizzard Entertainment has announced that it has made a 1.1 million dollar donation to the Make-A-Wish Foundation. The 1.1 million dollars came from a sale of a pet that can be used in World of Warcraft. The pet Pandaren Monk, was available in November of 2009 and has sold 220,000. Blizzard had stated that half of the money it got from the sale would be used for charity. The Make A Wish Foundation usually helps those kids who have a life threatening disease.

Chief Executive Officer Mike Morhaime, co-founder of Blizzard stated:


We’ve had a long relationship with the Make-A-Wish Foundation, and we’re proud to support the priceless work they do for children. This donation also reflects the spirit and generosity of our players – their enthusiasm for World of Warcraft and for supporting a good cause made this possible.” David Williams, who is the CEO of the Make-A-Wish Foundation, thanked Blizzard for its contribution saying that “This generosity is helping us bring hope, strength and joy to children when they and their families are facing an unimaginably difficult time in their young lives.
